Mark Hooshmand, Tyler Rougeau, Brian Trachuk, Alicia Sandoval, Cheryl’Berna Adams and Jacob Swanson of the Hooshmand Law Group, PC, recently obtained a $3.5 million jury verdict on behalf of a patient of a substance use treatment facility in San Jose, California. Our client checked into Support Systems Homes, Inc. in San Jose, California for detoxification and she converted to in patient treatment. Soon afterward an uncertified and unqualified counselor began having sexual contact with her. Through perseverance and dedication we were able to uncover many failures on the part of Support Systems Homes, Inc. that allowed the “counselor” to be alone with our client without any supervision. The jury found that both Defendants were negligent by a vote of 12-0 and that both the facility and the “counselor” were liable. The jury awarded $1.5 million for past emotional distress damages and $2.0 million for future emotional distress damages. While there is a serious need for treatment for those suffering from substance use addictions and disorders, it is critical that these facilities are properly managed and that the employees are properly trained and supervised.
